L'ex-chef rebelle congolais et général renégat Laurent Nkunda, détenu depuis près de six mois au Rwanda où il a été arrêté le 22 janvier, a demandé au président rwandais Paul Kagame de le libérer, selon un communiqué.
L'ex-chef de rébellion du Congrès national pour la Défense du Peuple (CNDP) a "été récemment autorisé à rencontrer son épouse" mais "ses droits fondamentaux d'être informé des motifs de son arrestation et de sa détention (…) sont toujours violés", écrivent ses proches.
"Dans ces circonstances, par l'entremise de son avocat, Laurent Nkunda s'est récemment de nouveau adressé au président de la République (rwandaise, Paul Kagame) ainsi qu'aux ministres des Affaires étrangères, de la Justice et de la Défense, afin d'être libéré sur le champ", est-il ajouté.
Une nouvelle requête exigeant" qu'il soit "présenté à un juge ou libéré sans autre délai" va être déposée devant la justice rwandaise, selon sa famille.
Laurent Nkunda avait mis en déroute dans le Nord-Kivu (est de la République Démocratique du Congo) l'armée congolaise en octobre 2008 avec l'appui de Kigali, arrivant jusqu'aux portes de Goma, le chef-lieu de cette province.
Retournement d'alliance
Mais à la suite d'un retournement d'alliance, les armées congolaise et rwandaise avaient lancé le 20 janvier une opération conjointe sans précédent contre le CNDP et les rebelles hutus rwandais dans l'est de la RDC, qui avait abouti à l'arrestation de Laurent Nkunda, le 22 janvier au Rwanda.
Placé depuis en résidence surveillée à Gisenyi (ville rwandaise frontalière de la RDC), l'ex-général a "récemment été transféré" à Kigali, selon ses proches.
Les ministres rwandais et congolais de la Justice se sont rencontrés au printemps pour discuter de son transfert en République Démocratique du Congo, mais sans résultat concret jusqu'ici.

UNLAWFULLY IMPRISONNED FOR SIX MONTHS LAURENT NKUNDA IMPLORES PRESIDENT KAGAME TO RELEASE HIM
As of 22 July, Laurent NKUNDA will have been arbitrarily detained on the territory of the Republic of RWANDA for six months.
Indeed, arrested and imprisoned without any basis by members of the Rwanda Defence Forces (RDF) under the command of James KABAREBE on 22 January – at a time when he had been invited to attend an official military meeting held at Hotel Belvédère in GISENYI – Laurent NKUNDA MIHIGO is still, six months later, unlawfully imprisoned on the territory of the Republic of RWANDA.
Initially detained in a secret location in the GISENYI area, Laurent NKUNDA was recently transferred to a new detention facility in KIGALI but still has not been presented before a Judge for the purpose of being informed of the reasons for his arrest and detention, which are entirely arbitrary.
Moreover, even though Laurent NKUNDA has recently been authorized to meet with his wife, his fundamental rights to be informed of the reasons for his arrest and detention and to meet with and be represented by his lawyer – guaranteed by the Constitution of the Republic of RWANDA, the African Charter of Human and People’s Rights and the International Covenant on Civil and Political Rights – are still violated.
In these circumstances, through his lawyer, Laurent NKUNDA has recently addressed yet again the President of the Republic as well as the Ministers of Foreign Affairs, Justice and National Defence, with the aim of being immediately released.
According to Me BOURGON who represents Laurent NKUNDA: “One would hope that this time, the President and his Ministers will hear my client’s appeal so that Justice may at last triumph in RWANDA and that he be released”.
A new application demanding that Laurent NKUNDA be presented before a Judge or released without any further delay will soon be presented, with the aim of ensuring that Laurent NKUNDA’s fundamental rights are respected.
